The Town of Winter Park filed suit on August 11, 2017, against Cornerstone, the West Mountain Metropolitan District, and Clark Lipscomb stopping the Union Pacific Railroad Underpass project near Kings Crossing Road resulting in significant delays and cost increases to the estimated $10 million dollar project.
The 2004 Haul Road Agreement Amendment places limits on construction traffic for the Underpass project and sets December 31, 2018, as the date the 2004 Haul Road Agreement will terminate.
The Town of Winter Park withdrew its request for TRO following the signing of the 2004 Haul Road Agreement Amendment and the injunction hearing scheduled in Grand County District Court for Friday, September 1, 2017, was vacated.
The Town will continue to pursue its lawsuits against Cornerstone, the West Mountain Metropolitan District, and Clark Lipscomb in an effort to get out of the agreements the Town of Winter Park made with Cornerstone and Fraser for the Leland Creek Subdivision in 2004.
The delays caused by the Town of Winter Park’s TRO will likely push the bridge construction well into 2018; an unfortunate delay for the community and more costs to an already expensive and complicated project.
